Is driving a moped without a muffler punishable by jail time?

i was driving today without a muffler on my moped and a cop wrote me a ticket under 46.2-1050 in virginia law. is this punishable by jail time what class charge is this? i have 30 days suspended in jail if i get in any trouble is it possible for me to recieve these 30 days when trial comes?
